The Human Side of the Landlord Tenant Relationship

 

  • As solicitors advising landlords we feel it is important to point out that the landlord and tenant relationship is not merely a contractual relationship: it is also a human one. Sound landlord advice starts with the recommendation that the landlord takes time to get to know his tenants and their problems in the hope of negotiating a solution.

  • A solicitor advising landlords should investigate the reason why the tenant has failed to pay rent. If, for example, the tenant has financial difficulties, been made redundant, or has had a marriage break-up, it may be possible to secure Housing Benefit payments from the local authority to help pay the rent.

  • Solicitors advising landlords often recommend that the tenant seek assistance from the various agencies offering help such as the local authority social services department dealing with housing benefit and local housing allowance benefits; the Housing Advice Centre and the Citizens’ Advice Bureau.

  • It may be possible to come to a mutually acceptable arrangement, such as agreeing on a re-payment plan. A solicitor advising a landlord should propose a plan of action with timescales for payments and back payments of arrears. This may include accepting smaller rent payments with increasingly additional amounts to pay off the arrears over a period of time, or agreeing for the tenant to pay a lump sum at some future date to make up arrears. Be realistic when drawing up any such repayment plan.
