Notices are important. A district jusdge will decide if a notice is valid. An incorrect notice will result in a landlord's claim for repossession to fail. In our experience a high proportion of letting agents and landlords get notices wrong as they are not aware of the complete statutory rules upon which notice selection, preparation, and service are based. Other factors such as when to serve which notice, verbal agreements, lost written agreements, written agreements with verbal variations, ambiguous tenancy agreement wording, agreements with typo mistakes, and incorrectly executed agreements also create difficulties.
A District Judge will review claim forms, the particulars of claim, the notice, and enclosures before giving an Order. Different types of Orders can be obtained depending on a Landlord's particular needs.
If the property is not vacated following an eviction order we instruct the court bailiffs to physically remove the occupiers. Typically the police will assist the bailiffs in this unpleasant task.
