How To Avoid The Legal Equivalent Of A Rogue Trader

Check if the organisation you are instructing is regulated by the Solicitors Regulation Authority.

Regulation offers you a great deal of protection through a strict code of conduct, an independent complaints procedure, access to the company's professional indemnity insurance policy to compensate you in the very rare event of negligence on our part, access to qualified lawyers and high service standards. Bartletts Solicitors Limited is regulated by the Solicitors Regulation Authority.Ultimate responsibility for any work we carry out on your behalf will rest with a senior property solicitor and director of our company.

Check if a solicitor will be responsible for your work.

Find out who will be taking responsibility for your case. Has this person even attended a course on landlord and tenant law! You will be shocked that non regulated 'law providers' have no legal qualifications. Ask if the supervisor is a solicitor. How long has he or she been qualified? What experience in property litigation do they have? At Bartletts either Ms. Louise Nelson or Mr. John Bartlett will take responsibility for your case. This will be confirmed in writing in our Client Care Letter. Both are senior property solicitors each with over 25 years of property litigation experience.

Has the organisation got a solid background in litigation?

Bartletts have over 30 solicitors involved in various types of litigation work (property, contract, & personal injury). It is important to understand that an eviction claim is not a small claim. This is an important point for you as a landlord because if a defence is filed by the tenant's legal aid solicitors substantial legal costs and damages can be awarded against you if your claim is unsuccessful. Once a claim is issued at court the landlord has to see it through. Therefore, a landlord needs to be sure that the organisation starting a claim at court on his or her behalf fully understands the course that a claim could take. For instance, the tenant may make a counterclaim against you for disrepair. Defending such a claim requires a solicitor specialising in property litigation.

  What could you lose?

Unfortunately there are many web-sites posing as legal experts but do not have a single solicitor within their organisation. As these people have no legal training their knowledge is superficial and they make mistakes costing landlords months of delay. Their work is easily picked apart by specialist legal aid housing solicitors that represent tenants on low income. As these Internet operators are not regulated there is very little landlords can do to recover their loses caused by this amateur work. We do provide a no win no fee service to sue these operators for their negligent work.

Instruct a regulated solicitors practice that has a specialist landlord & tenant department so that you pay fixed rates and receive a good service.

Bartletts offers landlords an efficient, highly professional, fixed fee service. Our experience and range of services allow landlords to resolve their difficulties quickly and maximise their chances of recovering rent.
